These Terms govern your relationship with the operator of the website grandrush-aussie.com in relation to your use of the Grand Rush online gambling services as presented on Grand Rush (the "Site"). By accessing or using any part of the Site or creating an account, you agree to be bound by these Terms and all policies referenced herein. If you do not agree, you must not use the Site. - Brand or Grand Rush means the online casino brand operated by the Operator and promoted on Grand Rush for Australian-facing users on an offshore basis.
- User or you means any natural person who accesses or uses the Site, whether or not they register an account.
- Player means a User who has successfully registered an account with the Operator and has been accepted as a real-money customer.
- Account means a personal user account created with the Operator for the purpose of accessing gambling services and maintaining balances in real or bonus funds.

User Obligations

- Chargebacks: Initiating a chargeback or payment dispute without valid grounds may be treated as a breach of these Terms and could lead to:

Limitation of Liability

Exclusions of Liability

Maximum Liability
- Cap on compensation: Without prejudice to mandatory statutory rights that may apply, the maximum aggregate liability of the Operator to you, whether in contract, tort (including negligence) or otherwise, for any claim relating to a specific Bet or game round is limited to:
- The amount of the Bet or stake placed by you in respect of that Bet or game round; or
- Where the claim does not relate to a specific Bet, the lesser of (i) the amount of your net deposits to your Account over the preceding three months, and (ii) AUD 1,000.

Permitted Use and Restrictions

- Prohibited acts: You must not, without the prior written consent of the Operator:

By using the Site, you acknowledge that you have read and understood that policy and consent to the processing of your data in accordance with it.
- Purpose of processing: Personal data may be processed for purposes including account administration, KYC and AML compliance, payment processing, risk management, customer support, marketing (where permitted) and compliance with legal obligations in Curacao and other relevant jurisdictions.
- Cross-border issues: Given the offshore nature of the Services and the targeting of Australian users, your data may be transferred to and processed in jurisdictions with different data protection regimes. Changes to Terms

Procedure and Consequences

- Access to funds: Upon termination not arising from serious breach or fraud, the Operator will, subject to KYC and AML checks, make reasonable efforts to allow withdrawal of your eligible real-money balance, excluding:
- Funds subject to unresolved chargebacks or disputes;

- Funds reasonably suspected to be linked to unlawful conduct.

- Dispute resolution: Before initiating formal proceedings, you should first contact customer support to attempt to resolve the matter amicably. If no resolution is reached within a reasonable period, you may pursue the claim through the relevant court or alternative dispute resolution mechanism where available under Curacao law. Nothing in this clause prevents you from exercising any non-waivable rights you may have under Australian consumer laws, to the extent they validly apply to offshore services.
